WHAT IS THE BASIS FOR THE HAIR STRAIGHTENER & HAIR RELAXER LAWSUITS?


The 11-year study by the National Institutes of Health (NIH), which included 33,497 women ages 35-74, showed those who used chemical hair straighteners were about twice as likely to develop uterine cancer as non-users. Researchers estimated that 1.64 percent of women who never used chemical straighteners would develop uterine cancer by age 70, while the rate among frequent users, defined as more than four times a year, rose to 4.05 percent.

The study did not find links between uterine cancer and other types of hair products such as dyes and perms.

Information in recent lawsuits against L’Oréal and other beauty companies allege that the businesses knew, or should have known, based on several epidemiological studies conducted over the past seven years, that the chemicals contained in their products were associated with an increased risk of cancer.

WHY ARE CHEMICAL HAIR STRAIGHTENERS AND RELAXERS SO DANGEROUS?


Most chemical straighteners contain potentially carcinogenic toxins that include formaldehyde and formaldehyde-releasing chemicals, phthalates, parabens and bisphenol-A.

Applying these products to the scalp, one of the most sensitive areas of the body, may cause burns or lesions that can facilitate the absorption of the harmful chemicals and allow them to spread to other areas of the body. In addition, heat-generating devices such as hair dryers and flat irons may release more toxins into the scalp.

 

WHAT IS UTERINE CANCER?


Uterine cancer is the most common type of cancer affecting the female reproductive system. Data from the National Cancer Institute showed a significant increase in the disease since 2000, particularly among Black women. Most uterine cancers develop in the endometrium, the inner lining of the uterus.

Common symptoms of uterine cancer include:

-  Vaginal bleeding between periods in pre-menopausal women

-  Vaginal bleeding or spotting after menopause

-  Lower abdominal pain or pelvic cramping

-  Vaginal discharge in post-menopausal women

-  Prolonged, heavy or frequent vaginal bleeding in women over 40

Treatment may include surgery, chemotherapy, radiation, medication or a combination thereof. Survival rates are higher for cancer that is detected in an early stage.

WHAT ARE THE ELIGIBILITY REQUIREMENTS FOR FILING A CHEMICAL STRAIGHTENER LAWSUIT?


Women diagnosed with uterine, endometrial or ovarian cancer may be eligible to receive compensation provided they meet the following conditions:

  • Used a chemical hair straightening or relaxing product at least five times in one year
  • Received a cancer diagnosis four years or longer after the first full year of product use

Women with a family history of uterine or ovarian cancer or those who have the BRCA gene mutation are typically ineligible to file suit.
