What to Expect From a Michigan Dog Bite Settlement

Home>The Bernstein Blog>What to Expect From a Michigan Dog Bite Settlement

An estimated 4.7 million people in the United States will be bitten by dogs this year. More than 800,000 of these dog bites will be severe enough to require medical attention. Most of these victims will be children, who are more likely to sustain serious injuries. Senior citizens are the second most common dog bite victims, followed by postal carriers.

When a dog turns vicious, the result can be devastating. The damages can include permanent scarring, nerve damage, serious infection and lasting psychological harm.

Who is Responsible When a Dog Bites?

The Michigan dog bite law, MCL 287.351, is considered a “strict liability” statute. This means a dog owner is responsible for any bite injury the dog causes to an individual. A dog’s previous “good behavior” does not protect the owner when a dog attacks and bites another person. The victim may still be able to file a lawsuit and collect damages, even if the dog has no history of biting.

The dog bite law also requires that the dog bite the victim “without provocation.” When a dog bite settlement is pending, the dog owner and the insurance company may try to accuse the victim of provoking the dog and instigating the attack. This is why it is so important to hire an experienced dog bite lawyer to present a case that will result in the maximum possible compensation.

What Will My Dog Bite Settlement Include?

A dog bite settlement depends on several factors, such as the severity of the injury and whether there is permanent scarring or other lasting physical or emotional damage. While it is important to retain a qualified dog bite attorney as soon as possible, your lawyer may want to postpone a final settlement until the extent of the damage or scarring can be thoroughly assessed.

How Long Do I Have to File a Dog Bite Claim?

Michigan law allows a dog bite victim to take legal action up to three years from the date of the attack. A victim under the age of 18 has until their 19th birthday to file a claim. Whatever the age of the victim, it is best to consult a dog bite lawyer as soon as possible to ensure the best possible outcome.

“A dog bite can result in serious physical injury as well as lasting psychological damage,” said Mark Bernstein of The Sam Bernstein Law Firm. “If you or a loved one is bitten by a dog, call us immediately. Our experienced dog bite lawyers will fight to get you the settlement you and your family deserve.”

Michigan dog bite law is complicated, but finding the right lawyer is simple.
