1. Sponsors: The Sponsors of this Call Sam Car Safety Kit are The Sam Bernstein Law Firm, PLLC, and the Michigan State Police.

2. Eligibility: All new drivers in Michigan who are age 18+ and minors whose parent or guardian has provided consent are eligible to receive the Call Sam Car Safety Kit.

3. Agreement to Rules: By requesting the Call Sam Car Safety Kit, the contestant (“You”) agree to comply with and abide by these Rules and you (and if applicable, your parent or guardian) represent and warrant that you meet the eligibility requirements.

4. How to Obtain The Call Sam Car Safety Kit: The Call Sam Car Safety Kit promotion may be be picked up at participating Michigan State Police posts or requested by using the online form provided at callsam.com/car-safety-kit .

5. Terms and Conditions: The Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Call Sam Car Safety Kit promotion should virus, bug, unauthorized human intervention, fraud, or other cause beyond the Sponsors’ control corrupt or affect the administration, security, fairness, or proper conduct of the Call Sam Car Safety Kit promotion. The Sponsors have the right, in their sole discretion, to maintain the integrity of the Call Sam Car Safety Kit promotion.

6. Limitation of Liability: By entering the Call Sam Car Safety Kit promotion you agree to release and hold harmless The Sam Bernstein Law Firm, PLLC, and the Michigan State Police, their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such applicant’s participation in the Call Sam Car Safety Kit promotion and/or his/her acceptance, possession, use, or misuse of any kit or any portion thereof; (ii) unauthorized human intervention in any part of the Call Sam Car Safety Kit promotion; (iii) electronic or human error in the administration of the Call Sam Car Safety Kit promotion or the processing of applications; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

7. Disputes: This Call Sam Car Safety Kit promotion is governed by the laws of the State of Michigan and the United States, without respect to conflict of law doctrines. By participating in this Campaign, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Michigan having jurisdiction. Further, in any such dispute, under no circumstances shall you be permitted to obtain awards for, and hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with applying for the Call Sam Car Safety Kit). You further waive all rights to have damages multiplied or increased.

8. How We Use Your Data: When you provide your email to us, all applicable Data regarding the email is stored and processed at The Sam Bernstein Law Firm, PLLC’s locations in Michigan. We may use your contact information to send you notifications regarding our services, and/or other promotions, and by entering you indicate your consent to receive such marketing and promotional communications. When you send email or other communications electronically, we may retain those communications to process your inquiries, respond to your request or question, and improve our services. This information may also be shared with the Michigan State Police to assist in fulfillment.  Other than as provided in these rules, your Data will not be shared with third parties without your explicit consent.

9. Acceptance of Rules: By participating in the Call Sam Car Safety Kit promotion, You have affirmatively reviewed, accepted, and agreed to all of the Official Rules, Terms and Conditions.

10. SEVERABILITY. The invalidity of any particular provision of this Agreement shall not affect the other provisions, and this Agreement shall be construed in all respects as if such invalid or unenforceable provisions were omitted.

11. ASSIGNMENT. The Firm shall have the right to assign, license and delegate this Agreement in whole or in part, or any or all of the above rights, obligations, options or privileges hereunder, to any entity.

12. Parental Consent For Minors: A Parent or Guardian must certify that they are the parent or guardian of the applicant named in the request form provided by Sponsors and consent without reservation to all of the terms and conditions specified in these Rules on behalf of the minor applicant using this form.
