Summary

Garret Gersin, Jason Turkish, and Michael Harris v. The Road Commission for Oakland County

This lawsuit was filed on behalf of three plaintiffs; one is blind, another is legally blind, and the third uses a wheelchair. The complaint alleged the Road Commission for Oakland County violated the Americans with Disabilities Act (ADA) by installing three roundabouts in West Bloomfield Township without providing equipment that would allow blind or otherwise disabled individuals to safely crossing these intersections. The suit was filed in U.S. District Court for the Eastern District of Michigan.

The firm won a landmark settlement that required the Road Commission for Oakland County to install safety equipment for pedestrians in each roundabout. The judge’s order included a 43-page outline detailing a timeline to research and install state-of-the- art automated pedestrian safety equipment.

As a result, all three roundabouts are now equipped with High Intensity Activated Crosswalk Systems and Rectangular Rapid Flashing Beacons.
