After a long day indoors, few things are more exhilarating than hitting the open road on your motorcycle. Whether it’s an evening ride to cast off the stresses of the workday, or a weekend adventure to a new destination, there is nothing quite like the feeling of being at one with your bike and the world around you.
Do You Have a Case? While riding has many rewards, it can also be risky. Motorcycle accidents typically result in more serious injuries and fatalities than auto accidents because the rider has little protection from the road or other vehicles.
If you are involved in a motorcycle accident, you may be tempted to file your own insurance claim. This is not recommended for numerous reasons. Here are a few:
Under Michigan No-Fault insurance law, motorcycles are not considered passenger vehicles. As such, the same coverages and protections provided under policies for automobiles or other motor vehicles do not apply.
The main difference is that most motorcycle insurance only provides liability coverage for bodily injury and property damage. The PIP (Personal Injury Protection) coverage that pays medical bills and rehabilitation when someone is injured in an auto accident is not included in standard motorcycle insurance policies. If a motorcycle driver or passenger is injured in a crash with a motor vehicle, compensation will come from the insurance company covering that motor vehicle.
When a motorcycle driver or passenger is injured in an accident that does not involve another motor vehicle, there are no insurance benefits under No-Fault motorcycle law. Examples would include colliding with another motorcycle, running into a tree or hitting a deer. Michigan insurance companies are required by law to offer optional motorcycle PIP coverage for these types of situations.
When looking for a motorcycle accident lawyer, seek out a firm with a proven track record. With complex regulations and stringent filing deadlines, you want a lawyer with extensive experience in the complex rules and statutes governing insurance claims for motorcycle accidents.
