More than 100,000 plaintiffs have won six- and seven-figure settlements in lawsuits against Bayer AG, manufacturer of Roundup® weed killer. If you or a loved one is suffering from non-Hodgkin’s lymphoma as a result of using Roundup®, you may qualify for compensation with the help of our experienced Roundup® cancer lawsuit attorneys. Here is what you need to know to receive the benefits you deserve.
Roundup® is a highly effective weed killer developed in the mid-1970s by the Monsanto Corporation, now owned by Bayer AG, a large, multinational German pharmaceutical and biotechnology company. What makes Roundup® so potent is its active ingredient, glyphosate, a broad-spectrum herbicide that is now the most widely used weed killer in the U.S. Glyphosate works by blocking the aromatic production chain path of plants, a process that is necessary for vegetation, including weeds, to survive.
While glyphosate is an extremely efficient weed killer, research shows repeated exposure to the chemical increases the risk of developing non-Hodgkin’s lymphoma (NHL), a form of cancer that affects the white blood cells.
A study published in the Journal of the National Cancer Institute showed farmers with regular exposure to glyphosate displayed significantly higher biomarkers for cancer compared to a control group that did not come into contact with Roundup.
Additionally, scientists at the International Agency for Research on Cancer (IARC), the research branch of the World Health Organization (WHO), concluded glyphosate is “probably carcinogenic” after extensively studying its effects animals and humans in several countries.
Furthermore, researchers at the University of Washington’s Department of Environmental & Occupational Health Sciences found exposure to glyphosate may increase the risk of cancer by as much as 41 percent.
To date, thousands of victims diagnosed with non-Hodgkin’s lymphoma have filed lawsuits against Monsanto and Bayer AG, with many more pending. In 2020, Bayer AG paid out more than $10 billion to settle close to 100,000 lawsuits, with additional funds set aside for pending and future claims.
In addition, individual plaintiffs have won multi-million-dollar settlements for the harm they suffered after repeated exposure to Roundup®.
The lawsuits cited the manufacturer’s failure to warn consumers about the dangers of Roundup® after published studies showed the connection between glyphosate and non-Hodgkin’s lymphoma. The Roundup® lawyers also claimed Bayer AG executives manipulated corporate research records to minimize the risk factors.
Non-Hodgkin’s lymphoma (NHL), also known as non-Hodgkin lymphoma or simply lymphoma, is a type of cancer that attacks the immune system through white blood cells called lymphocytes. The two types of lymphocytes are B-cells or T-cells. While non-Hodgkin’s lymphoma can affect either kind, B-cell lymphomas are more common.
The disease can start anyplace in the body where lymph tissue is found, although it can also involve the skin.
The most frequent sites are the lymph nodes, spleen, bone marrow, thymus, tonsils and adenoids, as well as the digestive tract.
What are the most common symptoms of non-Hodgkin’s lymphoma?
While these symptoms can indicate a variety of medical conditions, treatment for non-Hodgkin’s lymphoma and other serious disorders is more effective when the disease is detected early. Therefore, it is important to visit your physician promptly if you experience any of the above symptoms.
Because Roundup® is such an effective weed killer, it is used extensively in many different environments. Farmers use the product on a variety of crops such as almonds, peaches, onion, cherries, corn and citrus. In addition, those who maintain golf courses, commercial plant nurseries, forests and public parks rely on Roundup® to keep their properties weed-free.
While Bayer AG stopped selling Roundup® for residential use at the beginning of 2023, it may still be available from certain retailers who have leftover inventory. Homeowners who want to avoid the glyphosate-based formula should make sure they are buying the re-formulated version.
Here is a partial list of those who may be at risk of developing cancer from exposure to Roundup®:
Anyone who develops non-Hodgkin’s lymphoma after using Roundup® may be able to file a lawsuit. However, regardless of who the plaintiff is, every claim must offer proof that exposure to Roundup® caused the victim to develop cancer.
Eligible parties may include:
Direct victims
People who used Roundup® and were subsequently diagnosed with non-Hodgkin’s lymphoma may be eligible to sue Bayer AG for damages.
Family members
Spouses, dependents or other family members whose loved one used Roundup® and died from non-Hodgkin’s lymphoma may be able to file a wrongful death lawsuit against the product manufacturer.
Legal representatives
The estate manager for someone who died from Roundup®-related cancer may be able to sue Bayer AG on behalf of the victim’s estate. This could be a friend, relative, attorney or anyone legally designated to manage the estate.
Bayer AG discontinued residential sales of Roundup® products containing glyphosate at the beginning of 2023. According to its website, this decision is part of the company’s five-point plan to reduce future lawsuits, which were mainly brought by private homeowners.
The plan includes replacing the old Roundup® products with new formulations containing different active ingredients, although the company did not provide specific information on the new version.
Contact us immediately if you or a family member is diagnosed with non-Hodgkin’s lymphoma after using Roundup®. Even if you are not sure whether your cancer was caused by exposure to Roundup®, it is still a good idea to schedule a free consultation with one of our Roundup® cancer lawsuit attorneys for several reasons.
First, personal injury claims must be filed within a specified time frame, known as a statute of limitations. In Michigan, a plaintiff has three years from the date of the death or injury or the date the injury or illness was discovered or diagnosed. When an illness is caused by repeated use of a toxic product, the clock typically starts when the disease is diagnosed.
Also, it takes time to prove the disease was caused by repeated exposure to Roundup®. A successful lawsuit involves obtaining and evaluating extensive medical records in addition to establishing when and how often the plaintiff was exposed to the toxic weed killer.
Therefore, it is important to begin the legal process as soon as possible to comply with the filing deadlines and allow the necessary time to build a successful case.
